In 1992 in the Indra Sawhney Case, the eleven Judge Constitutional Bench of the Supreme Court gave directions to form State Level backward Class Commissions to examine, process, and recommend for the reservation of OBC Communities. In compliance. Pursuance of the same, in Tamil Nadu, the Tamil Nadu Backward Class Commission was formed. From 1992 to 2022 all the Chairman belong to only one community and their major concern or focus was on that community to which their belonged. The so called Chairman of the said TNBC were not judicious nor transparent. There were many regularities. We listed most of the irregularities and gave a representation to the National Commission for Backward Classes (NCBC). Since they did not take effective action, we filed a Writ Petition before the First Bench of Madras High Court: The First Bench of Madras High Court directed NCBC to expedite the enquiry and give a report within two months. On this NCBC initiated an enquiry against TNBC and the Government of Tamil Nadu but they left / handed over the enquiry to the Chief Secretary to the Government of Tamil Nadu. Immediately we filed a contempt petition in the first Bench. Ultimately the Government of Tamil Nadu revamped the Tamil Nadu Backward Class Commission and for the first time since it’s inception a BC Community retired Judge of Madras High Court become the Chairman of TNBC
