Striking Down 10.5% Reservation To Vanniars In Tamil Nadu:

Achievements

Every political party that ruled and now ruling the country and the State have been perpetrating gross injustice on OBCs. In centre since 1950 to 1990, there was no reservation for OBCs. None of the political parties nor Caste organizations or leaders bothered about it. Though Tamil Nadu was pioneer in taking up the causes of oppressed people (SCs, STs and OBCs), since 1989 the ruling government played political cards with OBC reservation. The Government that came to Power in 1989 played large by vertically splitting the OBC – Reservation which was 50%. This was done by over riding two Government Orders (GO MS No: 1564 and 1565 of 1985) issue by the previous Government and relying on the report of Amba Sankar which was termed as “manipulated & showed favoritism towards a particular community”. The sad part was none of the OBC – Community (barring the benefited Community) MLAs, MPs and Ministers raised their concern or voice for the affected lot. Amba Sankar Commission Report, Government Orders issued on it since 1985 and the proceedings of Tamil Nadu Backward Class Commission since 1992 etc., were concealed / kept in dark. To bring out the facts to light SFRBC stretched it’s nerves and with great difficulty we collected the vital documents and placed the same before the Division Bench of the Madras High Court – which correctly observed that “Amba Sankar Commission data were Unreliable” and struck down the 10.5% reservation – Tamil Nadu Act 8 of 2021. Later nine appeals were filed in Supreme Court by the Government of Tamil Nadu, PMK, Fmr.Minister C.V.Shanmugham and others. SFRBC fought tooth and nail in the Supreme Court. Ultimately the Supreme Court of India upheld the verdict of Madras High Court and struck down Tamil Nadu Act 8 of 2021 – which provided 10.5% Special Reservation.
